CALIFORNIA WRONGFUL DEATH LAWYERS

Under California Code of Civil Procedure (CCP) 377.60, a family is allowed to bring a cause of action for the death of a loved one caused by the wrongful act or neglect of another.

A wrongful death lawsuit is often coupled with an action under CCP 377.30, which are actions brought on behalf of the victim’s estate to compensate for losses suffered by the victim, as opposed to the family, for the wrongful act.

WRONGFUL DEATH DAMAGES

Damages in a wrongful death lawsuit include, but are not limited to:

  • Medical bills or medical liens;

  • Amounts the deceased would have earned as income;

  • Value of lost benefits (e.g. pension or health insurance);

  • Funeral and burial expenses; and

  • Compensation for loss of consortium (where a spouse or registered domestic partner is deprived of the companionship and intimacy of a living partner);

NOTE: Punitive damages are not available in a wrongful death lawsuit in California. However, punitive damages can be obtained through a Survival cause of action under CCP 377.30.
